On 16 January 2015 late in the evening the website of the Ministry of Justice published a statement that the NGO Committee Against Torture had been added to the register of non-profit organizations designated as ‘foreign agents’.

«We have a few questions for you,» a border guard told Sinaver Kadyrov, a Crimean Tatar activist, at the Armyansk checkpoint in northern Crimea on Jan. 23. Kadyrov was on his way to Kherson, in southern Ukraine, to fly to Turkey for medical treatment. It was the beginning of an ordeal that ended with a local court expelling him from Crimea, his home of almost 25 years.

Liquidation of an NGO on the formal grounds is not allowed


The Supreme Court of the Russian Federation has adopted the cassation decision on the judgement of the Samara regional court about the refusal to liquidate the public association "In defense of the electors' rights "Golos". In this case both the Supreme Court and the Samara regional court supported the human rights defenders in their opposition to the Federal Registration Service (FRS).

"The Court board agrees with the court's conclusion, which takes into consideration the significance of the defendant's violations, adequacy and proportionality of the extent of the state reaction, because the liquidation of the public association is not allowed only on the formal grounds of violations of the federal law, the liability for infringement must be used in compliance with the general legal principles of the legal liability and be proportional to violations and their consequences" C reads the cassation decision.

The representative of Samara "Golos" says that this conclusion of the court board is extremely important for the court and legal practice: "Before this day there were numerous cases when courts examining the suits of NGOs liquidation agreed with the FRS which usually demands to liquidate an organization on the formal grounds. This legal position of the Supreme Court should prevent this negative practice".
